Dower is the amount the husband undertakes to pay under the nikahnama, it is a debt owed to the wife arising from the marriage contract itself, recorded in columns of the nikahnama and payable on demand if prompt (muajjal), or on death or dissolution if deferred (ghair muajjal). Maintenance, by contrast, is a continuing monthly obligation that arises from the marital relationship so long as it subsists.
Confusing the two weakens claims. A wife who has received her dower has not thereby received maintenance, and vice versa. Both claims can be joined in one Family Court suit, together with claims for child maintenance, which keeps costs down and avoids contradictory outcomes across separate cases.
